Terms of Service

1. Acceptance of Terms

By registering for or using MedFollow AI ("Platform", "Service"), you ("Doctor", "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms constitute a legally binding agreement between you and Chatslytics Technologies, the operator of MedFollow AI.

2. Eligibility

You must be:

• A licensed medical practitioner registered with the Medical Council of India (MCI) or equivalent State Medical Council.
• At least 18 years of age.
• Legally authorized to enter into contracts in your jurisdiction.

By using the Platform, you represent and warrant that you meet all eligibility requirements.

3. Description of Service

MedFollow AI provides licensed doctors with:

• AI-generated patient care plans based on prescriptions uploaded to the Platform.
• Automated patient follow-up via WhatsApp — medication reminders, adherence checks, and symptom monitoring.
• Intelligent escalation alerts when patient responses indicate clinical concern.
• A web dashboard for managing patients, viewing escalations, and reviewing care plans.

Important: MedFollow AI is a clinical decision support tool. It does not replace professional medical judgment. All clinical decisions remain the sole responsibility of the registered doctor.

4. WhatsApp Business Integration

By connecting your WhatsApp Business Account during onboarding, you:

• Authorize MedFollow AI to send and receive WhatsApp messages on behalf of your practice via the WhatsApp Business Cloud API.
• Confirm that you have obtained valid informed consent from each patient before enrolling them on the Platform and sending them WhatsApp messages.
• Agree to comply with WhatsApp Business Policy and Meta's Platform Terms.
• Accept responsibility for maintaining the security of your WhatsApp Business credentials. Notify us immediately at admin@chatslytics.com if you suspect unauthorized access.

5. Doctor Responsibilities

You agree to:

• Use the Platform only for lawful clinical purposes consistent with applicable Indian medical regulations.
• Obtain explicit written or digital consent from patients before enrolling them on the Platform.
• Review all AI-generated care plans and escalation summaries before acting on them.
• Ensure patient contact information (phone numbers) is accurate and up to date.
• Not use the Platform to send unsolicited commercial messages or spam.
• Maintain the confidentiality of your login credentials and not share account access.
• Promptly respond to escalation alerts — SLA timelines (Critical: 15 min, Urgent: 60 min, Advisory: 4 hours) are guidelines, not guarantees.

6. Subscription and Payment

MedFollow AI operates on a subscription model billed monthly:

• MedFollow AI: ₹8,999/month (up to 500 patients per doctor)

A 30-day free trial is available for new accounts. Payments are processed by Razorpay. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are not provided for partial billing periods. You may cancel at any time from your dashboard.

7. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy, incorporated into these Terms by reference. You are the data controller for your patients' data; MedFollow AI acts as a data processor on your behalf.

You are responsible for complying with applicable data protection laws (including India's Digital Personal Data Protection Act, 2023) regarding your patients' personal health information.

8. Intellectual Property

All software, algorithms, UI, branding, and content constituting the MedFollow AI Platform are owned by Chatslytics Technologies and protected by Indian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform for your clinical practice during an active subscription.

You retain ownership of all patient data and prescription content you upload to the Platform.

9. Disclaimers and Limitation of Liability

The Platform is provided "as is" without warranties of any kind. MedFollow AI does not guarantee clinical outcomes, the accuracy of AI-generated care plans, or the timeliness of message delivery.

To the maximum extent permitted by law, Chatslytics Technologies shall not be liable for:

• Any adverse patient outcome arising from reliance on AI-generated suggestions.
• WhatsApp message delivery failures caused by Meta infrastructure, network issues, or patient device status.
• Data loss caused by circumstances beyond our reasonable control.
• Indirect, incidental, consequential, or punitive damages.

Our total liability in any 12-month period shall not exceed the subscription fees you paid during that period.

10. Termination

We may suspend or terminate your account immediately if you:

• Violate these Terms or WhatsApp Business Policy.
• Engage in fraudulent, abusive, or unlawful activity.
• Fail to pay subscription fees after a 7-day grace period.

You may terminate your account at any time. Upon termination, you may export your data within 30 days. After that period, data will be deleted per our retention policy.

11. Governing Law

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.

12. Changes to Terms

We may modify these Terms at any time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Platform after the effective date constitutes acceptance.
